Governor Cuomo today unveiled a package to protect New Yorkers, as well as government entities, from cyber-attacks. The package includes the strengthening and modernization of cybercrime and identity theft laws, as well as the creation of a new Cyber Incident Response Team to provide cybersecurity support to state entities, local governments, critical infrastructure and schools. Many of the New York’s criminal laws that protect financial or intellectual property and ensure privacy have not kept pace with this growth.

State Police in Endwell announced that they have located 22-year-old Allyson Cheechalk-Buttman of the Town of Union, who was reported missing on December 29th. Cheechalk-Buttman was located out-of-state and spoke with troopers, she was safe & in good health, the investigation is closed & no criminal charges were announced.

A Village of Sherburne resident was arrested by the Chenango County Sheriff’s Office. Deputies arrested Tracy Boyer on 1 felony count of Grand Larceny, Boyer is accused of possessing stolen property valued at $2000 that was taken from a residence in Smyrna. Boyer was released on her own recognizance on an appearance ticket to return to the Town of Smyrna Court at a later date.

25-year-old Joshua Underwood appeared in Oneonta City court Wednesday, he was charged with 2nd degree murder, attempted arson & criminal possession of a weapon, in connection with the beating death of 52-year-old Mark Morrison, at 229 Main Street in Oneonta. Underwood is accused of hitting Morrison with a weight from exercise equipment while Morrison slept, & then unsuccessfully trying to set a fire to cover up the crime, in the early morning hours of January 1st. Underwood faces a felony hearing January 18th, he is being held in the Otsego County jail without bail.

State Police issued 33,153 tickets during the holiday season “Drive Sober of Get Pulled Over” campaign. The special traffic enforcement period from Friday, December 16, 2016 through Sunday, January 1, 2017, which also included local law enforcement agencies, was designed to significantly reduce deaths and injuries caused by drunk or impaired driving.

Governor Cuomo today unveiled a new Enhanced Middle Class Child Care Tax Credit that will help more than 200,000 middle class families make their child care more affordable. The Enhanced Middle Class Child Care Tax Credit would supplement the current New York State Child and Dependent Care Tax Credit and more than double the benefit for families earning between $60,000 and $150,000. Retail Giant Macy’s announced that 68 stores will be closing worldwide in 2017. New York store closures include the Oakdale Mall store in Johnson City, as well as stores in Clay & Rochester, affecting over 140 employees. The Delaware county board of supervisors has chosen the first woman chair of the board this week; Tina Mole of Bovina is the new chairperson of the board. Mole has represented the town of Bovina for 13 years, she also works for State Senator John Bonacic, and she replaces Jim Eisel of Harpersfield, who served as chairman for 15 years.

State Comptroller Tom DiNapoli released the results of an audit of the town of Walton. The audit showed that the Supervisor appointed the Clerk to act as his bookkeeper; however, the New York State Attorney General’s office has expressed the view that the office of the Clerk is incompatible with the Supervisor’s bookkeeper position. They also found that No annual audit is performed of the records of the Clerk or Supervisor. The Audit recommends The Supervisor should maintain the financial records or appoint a bookkeeper that does not have incompatible duties, such as those of the Town Clerk. The Board should conduct an annual audit of the records and reports of any Town officer or employee who received or disbursed moneys on behalf of the Town, or engage an independent public accountant to do so.

State Police have launched a new website which includes instructions regarding license re-certification. Anyone holding a pistol license prior to the passage of the NY-SAFE Act has until January 31, 2018 to recertify. State Police will create the re-certification procedure and have launched a website troopers.ny.gov/Firearms – that includes the re-certification form. License holders can fill out the form online or print a paper version and return it by mail.

Governor Cuomo today announced the impact of potential repeal of the Patient Protection and Affordable Care Act on health care coverage of New Yorkers and the state budget. If the repeal of the Affordable Care Act were enacted, an estimated 2.7 million New Yorkers would lose coverage and New York State would experience a direct state budget impact of $3.7 billion and a loss of nearly $600 million of federal funding that goes directly to counties, which they use to help lower property taxes, in the 4 county region, almost 40,000 families would be adversely affected.

State Police responded to a 1 car fatal crash in the Town of Cortlandville. Responding troopers observed a 2001 Honda Civic that had rolled over onto its roof 23 year old Ryan Card of Cortland was driving the vehicle, he failed to negotiate a curve & drove off the west shoulder, striking some trees then rolling over down an embankment. Card was pronounced deceased at the scene. 2 passengers suffered & were taken to Syracuse area hospitals with various injuries, the investigation is ongoing.

New York ranks 3rd on the list of Most Moved from States in 2016, according to the 2016 National Movers Study by United Van Lines. More residents were moving out of New York than into New York, with nearly 63% of moves being outbound. Residents moved due to factors including work, retirement, and family, high taxes, High utility costs & low wages, according to the study. The state that ranked worse that New York were New Jersey & Illinois, the state with the highest percentage of people moving in, was South Dakota.

Many new laws Took effect in New York for 2017. One new law said that New Yorkers would be offered an additional opportunity to document their decision to enroll as an organ and tissue donor. On Saturday at 4:47 PM, Tioga County 911 received numerous calls regarding an explosion, On Sunday, a continued search of the named areas resulted in a blast site being located in the vicinity of Diamond Valley Road, Town of Tioga. Investigation at the scene indicated an unknown type of explosive substance was detonated in a field causing no damage but leaving a hole in the ground. The New York State Police and FBI Bomb Disposal Units processed the site with evidence collected for analysis. Collected evidence is being forwarded to the FBI lab in Quantico, Virginia for chemical testing. Anyone with information is asked to contact the State Police at 687-3961.

State Police are seeking the public’s assistance in locating 22-year-old Allyson Cheechalk-Buttman, who was reported missing by her mother. She left her residence on the morning of December 29th, and she may have traveled by bus to New York City, she was last seen wearing a light brown coat, green fleece, dark pants and black sneakers. She is a white female, 5’6”, 160 pounds, with brown-hazel eyes and medium brown hair. The public is asked to call the State Police at 775-1241 with information.

State Police arrested 31-year-old Anna Rodriguez of Binghamton for allegedly driving under the influence of alcohol in a stolen vehicle after a pursuit in the town of Sanford on Sunday afternoon. Troopers observed a vehicle traveling on State Route 17 in the town of Sanford at 94 miles per hour. The vehicle stopped briefly, then fled at a high rate of speed and crashed a short time later; Rodriguez was taken into custody & was treated for minor injuries at Wilson Memorial Hospital and released. She was charged with driving while intoxicated, unauthorized use of a vehicle, unlawfully fleeing a police officer in a motor vehicle, unlawful possession of marihuana, and numerous traffic violations. Rodriguez was arraigned in the village of Deposit Court and remanded to the Broome County Jail on bail.

Delaware County Sheriff’s Deputies arrested 30 year old Anthony Hebbard of Treadwell on charges of felony aggravated unlicensed operation of a motor vehicle 1st degree, felony aggravated driving with a BAC of .18% or greater, felony DWI, operating a motor vehicle in violations of ignition interlock, leaving the scene of a property damage motor vehicle accident and moving from lane unsafely following  a report of a 1 car MVA on County Highway 14 in the Town of Franklin. Hebbard is accused of having a BAC of .21%, he will appear at Franklin Town Court at a later date.

Several New laws went into effect for 2017 in New York State. A new law updates the state’s Public Health Law to ensure that newborns are covered retroactively under the Child Health Plus program. Newborns were not eligible under the previous requirements of CHP for periods lasting up to 30 days after enrollment. Newborns will be covered going back to the first day of their birth month.

Delaware County Sheriff’s Deputies arrested 57-year-old David Hayes of Coventry, Connecticut for aggravated unlicensed operation of a motor vehicle. Hayes is accused of driving a motor vehicle while having two active suspensions on his license. Hayes was additionally charged with driving with an out headlight and was released on traffic tickets returnable to Franklin Town Court at a later date.

The Chenango County Sheriff’s Office arrested 26-year-old Benjamin Geers of Beacon for 1 count each of Harassment & Endangering the welfare of a child. Geers was charged following an investigation of a domestic dispute in the Town of Plymouth, Geers allegedly subjected a female victim to unwanted physical contact in the presence of a child under the age of seventeen. Geers was arraigned in the Town of Smyrna court and was released on his own recognizance, he will appear in the Town of Plymouth court at a later date.

The State’s minimum wage has increased to $9.70 in the Upstate Counties of New York, Governor Cuomo commented about the increase this afternoon:

The minimum wage will go up another 70 cents an hour each year after until reaching $12.50 on December 31st of 2020, the minimum wage will continue to increase to $15 on an indexed schedule to be set by the Director of the Division of Budget in consultation with the Department of Labor. Governor Cuomo issued the first conditional pardons to more than 100 New Yorkers who were convicted of a non-violent crime when they were minors, and who have since lived crime-free for 10 years or more. This marks the first round of executive youth pardons since the Governor announced this first-in-the-nation action in December 2015 and is the largest number of clemencies issued in any year since taking office in 2011.

Many New Laws went into effect with the New Year. Battling the Heroin crisis was among the top priorities, with new laws Ending Prior Insurance Authorization for Immediate Access to Inpatient Treatment Services  and Expanding Access to Naloxone/Opioid Reversal Medication Coverage by requiring insurance coverage for the overdose reversal medication, whether it is prescribed to a person who is addicted to opioids or their family member covered under the same insurance plan.


Oneonta Police arrested 25-year-old Joshua Underwood of Oneonta for 2nd degree murder, attempted arson & criminal possession of a weapon. The crime occurred early Sunday Morning in an apartment at 229 Main Street in Oneonta; Underwood is accused of killing 52-year-old Mark Morrison of Oneonta by blunt force trauma to the head, & setting a fire to cover up the crime. Underwood was arraigned & was remanded to the Otsego County Jail on $50,000 cash bail or $100,000 bond, the investigation is continuing.

State Police arrested 38-year-old Donald Moshier of Triangle, and 32-year-old Rachel Wells of Triangle for unlawful manufacturing of methamphetamine after a traffic stop on State Route 11 in the town of Barker. Both were arraigned and were remanded to the Broome County Jail with no bail.

Governor Cuomo announced that between December 21st to 23, Members of the administration participated in volunteer events held at 18 organizations statewide to distribute 4,065 toys, coats and school supplies to communities in need. Donations, provided by businesses and individuals, were brought to drop-off locations across the state and collected by organizations at holiday gatherings ahead of the distribution events.

Tests of residential basements in New York State found elevated radon levels in about 37% of the homes.

State Police responded to a 2 vehicle fatal collision on I-88 Wednesday night in the Town of Colesville. 23 year old David Murrer of Harpursville struck another motor vehicle, driven by 64 year old Synthia Baciuska & occupied by her husband 67 year old Lynn Baciuska both of Afton. The Baciuska vehicle left the roadway and overturned, Mr. Baciuska was ejected & was declared dead at the scene, Mrs. Baciuska was transported to Wilson Hospital for non-life threatening injuries. Murrer suffered minor injuries and refused treatment at the scene, he was charged with Vehicular Manslaughter and DWI & was arraigned in Town of Colesville Court & he was remanded to the Broome County Correctional Facility on $2,500 cash or $5,000 bond. Anyone who may have information regarding this accident or witnessed this incident is requested to contact State Police at 775-1241. The investigation is continuing.

State Police in Binghamton are looking for information that may lead to the whereabouts of a Binghamton man who fled from troopers in a reported stolen vehicle. On Tuesday, December 27th, state troopers pulled over 28 year old Ryan Markoff of Binghamton, in the town of Kirkwood, after he was observed driving a vehicle that was reported stolen. Markoff drove off as troopers were interviewing him and headed north into the city of Binghamton. State Police pursued Markoff through the city, and terminated the pursuit shortly after he entered Pennsylvania. Markoff was last seen driving a blue 2011 Kia Sorento, New York registration FPX 4416. He may have possibly traveled to Montrose, Pennsylvania and is known to frequent the Windsor and Hancock areas. Governor Cuomo announced that new health insurance reforms aimed at combatting New York State’s heroin and opioid crisis will go into effect January 1st. These reforms were part of the legislative package that the Governor signed this year, health insurance plans will be required to cover treatment services provided to New Yorkers suffering from opioid addiction, increase access to treatment, expand community prevention strategies, and limit the over-prescription of opioids in New York.

Broome County District Attorney Steve Cornwell announced on Thursday that there have been 76 confirmed overdose deaths in Broome County this year. Of the 76 deaths, The average age was 37, 63% were male; 37% were female, 90% of the deaths were attributed to heroin or opioids; 10% to other drugs.

Governor Cuomo today announced the launch of a new public awareness campaign reminding New Yorkers that the first increase to the minimum wage will go into effect on December 31st. Governor Cuomo signed legislation this year making New York the first state in the nation to enact a $15 minimum wage to be phased in over several years. Minimum wage workers who do not receive their raise should call 1-888-4-NYSDOL to report their employers. Locally, the minumum wage will be increased to $9.70 an hour. 32-year-old Jacob Fowlston of Norwich was arrested by Norwich Police Wednesday afternoon and charged with a hate crime, following an alleged assault on December 24th on Fair Street in Norwich. Fowlston is accused of making racial slurs at the victim before striking him. Fowlston was arraigned & faces a felony hearing on Tuesday in Norwich City Court.

State Health Commissioner Dr. Howard Zucker today declared influenza prevalent in New York State. With this declaration, health care workers who are not vaccinated against influenza must now wear surgical or procedure masks in areas where patients are typically present. Flu activity in the State is now considered to be widespread, with laboratory-confirmed cases in 39 counties and all boroughs of New York City. So far, 658 flu-related hospitalizations have been reported, and there have been no reports of pediatric deaths from flu.

There will be no meeting of the Tri Town Coalition on Substance abuse this month, but meetings are scheduled beginning in January, and a Narcan Training session could also be added to the schedule next year, according to spokesperson Lorraine Keckeisen:

Meetings are scheduled for January 25th, at the Sidney High School at 6:00 to 7:30 in the library, meetings are also scheduled for February 15th, & March 22nd.

Delaware County Sheriff Deputies arrested 29 year old Michael Walters of Davenport at the Town of Davenport Court while being arraigned on separate charges. Walters was charged with 3 counts of Criminal Contempt, and 1 Count of Harassment, from a previous domestic dispute with the protected party of the order of protection. Walters was remanded to the Delaware County Jail in lieu $5,000 cash bail, he will reappear in the Town of Davenport Court at a further date.

State Police arrested 31-year old Steven Calderon of the Bronx, for allegedly using deceased State Trooper Timothy Pratt’s identity to obtain a $5,000 credit line and buy a washing machine. Trooper Pratt was killed in an accident on October 26th, Calderon was charged with 2 counts of identity theft. The investigation is continuing and police believe that more arrests may be forthcoming

The New York State United Teachers union has renewed its call for state Education Commissioner MaryEllen Elia to remove former Gubernatorial Republican candidate Carl Paladino from the Buffalo City School Board of Education, after Palladino made racist & offensive remarks about Outgoing President Barack Obama, and first lady Michelle Obama. The union officials stated that Palladino is unfit to serve in a school board position after making remarks wishing for President Obama’s death next year.

Broome County Assemblywoman Donna Lupardo vows to continue forward ing a bill to strengthen the state’s parking garages. the bill failed to pass this year despite sponsorship from lawmakers in the majority party in each house of the legislature. The bill follows the collapse of a parking garage at Wilson Hospital in Johnson City in July 2015.

State Police are searching for 42 year old Richard Darlin on charges of Grand Larceny & Criminal Mischief, for allegedly stealing property while staying at a residence on Mills Creek Road in Otego in March 2014. Darlin is accused of stealing a car, power tools, coins, cash and more. the town of Otego Court issued a warrant for his arrest. Governor Cuomo today announced that New York State has received $7.7 million in federal funding that will allow the state to fund 11 new programs and support 117 existing programs that help victims of domestic violence and sexual assault. Locally, The Crime Victims Assistance Center of Broome County will receive $35,600 to partially fund a sexual assault forensic examination program coordinator for a sexual assault response team.
