The United States Department of Justice announced Tuesday that 30 year old Shelby Ortiz of Maryland, New York was sentenced to serve 15 years in prison and a 20-year term of supervised release, for distributing child pornography. Ortiz also will be required to register as a sex offender upon her release from prison. Ortiz pleaded guilty in October 2022, she admitted that she subjected a 7-month-old boy to sexual contact which was video recorded and sent to to a person living in Florida with whom she was participating in an online and telephone dominant/submissive sexual relationship. The Otsego County Sheriff’s Office announced that 27 year old Brandon Morse of Edmeston was charged with cashing a stolen check last month was arrested again over the weekend for falsely reporting an incident to law enforcement. Morse is accused of lying to authorities about a man outside of his residence with a gun. Prior to the February arrest, Morse allegedly stole a $3,500 check from a local business and cashed it illegally. Morse was released with an appearance ticket and is due back in court at a later date.

Delaware County Board of Supervisors were notified that the federal civil rights suit filed against the County by former Social Services Commissioner Dana Scuderi-Hunter, was dismissed by the U.S. District Court Monday. Scuderi-Hunter had filed the civil rights suit last year, claiming that the County had violated her 1st Amendment rights; that she was denied due process as part of her 2019 dismissal; and that the County’s actions were retaliatory as a result of her testimony during a Family Court proceeding. U.S. District Court Judge Lawrence Kahn, ordered the claims made by Scuderi-Hunter be dismissed on the basis that the claims had already been litigated and decided by the State Appellate Division in February 2022, she additionally appealed that decision, which was denied last June, she then sought an appeal from the State Court of Appeals which was also denied. Judge Kahn also dismissed Scuderi-Hunter’s claims that County Attorney Amy Merklen had a conflict of interest in carrying out her duties as assigned.

The Village of Sidney Police Benevolent Association endorsed Acting Delaware County District Attorney Shawn Smith in this year’s race for the the Delaware County District Attorney’s Position. The Association stated that they reached this decision following an increase in communication, transparency & compassion from the DA’s office & Staff since Smith became the Acting DA January 1st. Delaware County District Attorney’s office announced that 71 year old Vincent Balsamo of Walton was arraigned on a sealed indictment in Delaware County Court Monday. The Indictment charges Balsamo with 2nd degree Manslaughter, 2nd degree Assault & Reckless Endangerment, for repeatedly choking, strangling & slapping & striking 52 year old April Kestner of Honesdale Pennsylvania at his residence in the Town of Walton in December 7th of 2022. Balsamo faces 5 to 15 years in jail on the Manslaughter charge, he was sent to the Delaware County Correctional facility on $50,000 cash bail or $150,000 bond.

During the course of the investigation Sheriff’s Deputies identified the driver as 21 year old Edwards Khali of Delhi, Deputies discovered that Khali’s vehicle was suspended due to an insurance lapse. Broome County District Attorney Mike Korchak announced that 32 year old Zeke Wilmarth of Binghamton pleaded guilty to 2nd degree attempted murder, Criminal possession of a weapon & Strangulation, in connection with the attack on his girlfriend in July of 2021 in the town of Vestal. Wilmarth is expected to be sentenced to 15 years to life upon sentencing in June.

Governor Kathy Hochul & Lieutenant Governor Brian Benjamin wrote an op-ed piece in a Downstate news paper this week, they claimed that New York’s Bail Reform doesn’t need to be repealed, but there are changes needed to the law. Governor Hochul wrote that problems that needs to be addressed include Repeat offenders, those accused of hate crimes, judges should be allowed to set bail; even if the crime would not currently be bail-eligible. The Governor wrote that judges should be able to set bail in all felony cases involving illegal guns, including guns given or sold to minors, & in crimes involving guns, judges should be able to set more restrictive pretrial conditions

Organizers of Woodstock 50 are declaring that the festival is still on after a Manhattan court judge ruled Tuesday that the event’s financial backer, Amplifi Live didn’t have the right to cancel the festival, without the approval of Woodstock 50’s organizers. Woodstock 50 also requested that Amplifi Live be made to return nearly $18 million in funds that organizers claimed the company misappropriated, but the judge ruled that that matter needed to be determined by arbitration. Woodstock 50 had been scheduled for August 16th to the 18th at Watkins Glen International Speedway.

State Police at Norwich are looking for the public’s help in locating a 43-year-old woman from Greene who is in need of medication. Arzou Hami was last seen on Sunday, October 7th exiting a vehicle near State Highway 369 in Port Crane. Hami has also identified herself as Michelle Girard. She was last seen wearing white capris, slip-on shoes, a dark shirt and carrying two suitcases, she is white, approximately 5’7, 165 pounds with short brown hair and brown eyes. Chenango County Sheriff’s Department investigated a robbery Tuesday Night on Royal Avenue in the Town of Norwich, after a male victim went to Chenango Memorial Hospital with missing teeth, head lacerations and additional trauma. The investigation revealed that the victim was lured to the Royal Avenue address by 19 year old Jade Orlando, who requested marihuana to be delivered to her, Brenden Gager, Hunter Speenburgh and Landon Cummings were hiding nearby, they allegedly assaulted and robbed the victim. All 4 were arrested & were charged with Robbery & Assault; they were arraigned and remanded to the Chenango County Correctional Facility. The City of Norwich Police Department assisted with the investigation. The investigation is ongoing and additional charges are expected.

The State Department of Transportation will hold a public open house meeting on Wednesday, September 26 at Afton Central School, from 5:30-7:00 pm to discuss 2 bridge replacements on State Route 41 in the towns of Afton and Coventry. The project will replace the bridge carrying Route 41 over Cornell Creek in the town of Afton as well as the bridge carrying Route 41 over Wilkins Brook in the town of Coventry. Both bridges, which were built in the 1930s, are inspected regularly and safe for continued travel. The bridges will likely be replaced during separate construction seasons in 2020 and 2021. Governor Cuomo directed agencies specializing in disaster recovery and clean-up to the Finger Lakes and Southern Tier To assist counties after heavy rains and flash flooding that caused damage to roads, bridges, homes and other critical infrastructure. The National Guard has deployed 50 personnel and is staging an additional 150 personnel for deployment to assist local governments with debris removal and cleanup. Damage assessment teams specializing in engineering and structural assessments from the Department of Transportation will be operating in the Southern Tier and Finger Lakes to evaluate roads, bridges and other infrastructure for damage and safety concerns.

Otsego County’s 21st Annual Household Hazardous Waste Days will be held on September 7th and 8th. Otsego County Residents can bring household hazardous waste, such as enamel paints, pesticides, antifreeze, batteries and more FREE of CHARGE for proper disposal. Last year 550 cars from an estimated 600 households brought various hazardous materials for disposal. NO REGISTRATION FOR HOUSEHOLD COLLECTION. Household collections will be held on Friday, September 7th at the Unadilla Town Barn from 8:00AM to 11:00 AM, and Saturday, September 8th at the Meadows Office Complex in Cooperstown from 8:00AM to 1:00PM.

State Police arrested 36 year old Luke Remillard of Otselic for criminal mischief, for allegedly intentionally smashing his car at a residence in April. Remillard was arraigned & was remanded to the Chenango County Jail on $1,000 cash bail pending court action on May 14th.

Attorney General Eric Schneiderman has resigned, following a report on allegations of assault by multiple women in The New Yorker. The Manhattan District Attorney’s office said they had opened an investigation into the allegations of Schneiderman being physically violent to women; Governor Cuomo called for his resignation Monday. Delaware County Sheriff’s Deputy’s arrested 61 year old Robert Wenzel of Delhi for DWI, failure to maintain lane, after a motor vehicle accident on State Highway 28 in the Town of Delhi. Wenzel was arraigned in the Town of Delhi Court and was released on his own recognizance and is scheduled to appear at a later date.

State Police arrested 46 year old Marc McKercher of Union for Attempted Arson, after troopers received a complaint of 2 suspicious devices on the front steps and front lawn of a residence on King Street in Endwell. Further investigation revealed the items were improvised explosive devices which did not detonate successfully. State Police Bomb Disposal Unit was called to the scene and rendered the items safe. They secured the items from the scene, the investigation is continuing.

Chenango County Sheriff’s department arrested 19 year old Johnathon Gemberling of Norwich on a warrant for failure to comply with his conditions following a conviction of Criminal possession of a controlled substance. Gemberling was apprehended following a foot pursuit and was taken into custody; deputies discovered Suboxone and methamphetamine in Gemberling’s possession. Gemberling was charged with 2 counts of Criminal Possession of a controlled substance, resisting arrest and on 2 active warrants, he was remanded to the Chenango County Jail & will appear in Chenango County Court and Town of Norwich court at a later date.

Governor Cuomo today urged New Yorkers who live in areas along streams and rivers to take precautions against potential ice jam flooding in the wake of much warmer temperatures and rain expected this week. The combination of warm temperatures, some rainfall and snowmelt could lead to more ice jam movement and minor flooding Tuesday afternoon into Thursday. State Comptroller Tom DiNapoli is urging New Yorkers to read the fine print on gift cards this holiday season for details about fees and expiration dates. DiNapoli said New Yorkers should use their gift cards within a year of purchase to avoid inactivity fees and register cards with the retailers that offer it so the owner can be identified. Money from unused gift cards issued by New York businesses is turned over to the State Comptroller’s office as abandoned property after five years of dormancy.

Delaware County Sheriff’s Deputies & the State Division of Parole located and arrested 33 year old John Barnett of Margaretville & charged him with being a Fugitive from Justice. Barnett was wanted from the Prince Edward County, Virginia Sheriff’s Office on 5 counts of Violation of Probation for failure to pay restitution following burglary and larceny convictions. Governor Cuomo today announced grant awards totaling $2.3 million for urban forestry projects in communities across New York. Delaware County Sheriff’s Office and K-9 Ozzie assisted the Delaware County Corrections Officers with a routine Jail Search, which revealed that William Effner was in possession of a powdery substance believed a crushed prescription medication, that he may have acquired from another inmate. Investigators arrested Effner for Promoting Prison Contraband; he will be arraigned on the charges in the Village of Delhi Court Tuesday.

27-Year-old Jihad Ray of Binghamton pleaded guilty to Manslaughter in Broome County Court, in connection with the shooting of Brandon Hernandez of Binghamton on April 22nd. Ray pleaded guilty to manslaughter in the first degree, a class B felony, in Broome County Court on Wednesday. Ray faces sentencing on December 14th, where he will be sentenced to 18 years in prison with an additional five years of parole.

Governor Cuomo announced New York has expanded eligibility for crime victims’ compensation for individuals who have no other way to pay expenses resulting from the crime. Victims of hate crimes and certain other offenses that are not physically injured, and vulnerable elderly or disabled individuals incapable of caring for themselves who have lost up to $30,000 in savings, can now seek compensation from the state Office of Victim Services. The Legislation went into effect Tuesday and applies to claims for medical and counseling bills, funeral and burial costs, and lost wages and support.
