Delaware County District Attorney’s office announced that 45 year old Timothy Bennett of Walton, pleaded guilty to Aggravated Driving While Intoxicated by alcohol and Aggravated Unlicensed Operation of a Vehicle, Wednesday. Bennet crashed his car in January on State Highway 10, in the Town of Walton. The investigation revealed that the Bennet was intoxicated by alcohol and had a BAC of .18 & had a suspended driver’s license, he was sentenced to a 3-year term of probation supervision, he must complete the impaired driver program and a victim impact panel, undergo a drug and alcohol evaluation, & he must install an ignition interlock device in any vehicle he owns, his license was revoked for a minimum of 1 year, and he was ordered to pay over $1600 in fines and surcharges.

The state DEC is not doing enough to ensure rechargeable batteries are recycled as required by law, according to an audit by State Comptroller Tom DiNapoli. Rechargeable batteries can contain toxic metals such as mercury, lead, cadmium, nickel and silver, and lithium-ion, all of which can pose a threat to the environment and human health and safety if they are not properly recycled. If they’re just put in the garbage and enter the waste stream, they can end up in landfills and their chemicals can leak into public water systems, lakes and streams. Lithium-ion batteries can ignite or explode if they are damaged in the waste stream and were the cause of a six-alarm fire on a trash barge in December 2021.

The State Health Department is reporting a slow increase in COVID 19 cases, with over 5800 positives tests out of over 72,000, for a 7.8.% positivity rate Tuesday. Patient Hospitalization have gone back over 2000 statewide, ICU patients were back up to 186, with 73 on ventilators, there were 12 deaths in hospitals & nursing homes.

State Police arrested 19-year-old Edward Gaydos for allegedly breaking into Smoker’s Choice in Oneonta. On June 26, state police were called to the scene around 2:30 AM, Gaydos was charged with 3rd-degree burglary, He was released on his own recognizance and is scheduled to appear in court on July 7.

U.S. Marshals & Norwich Police arrested 32 year old Ryheem Miller of North Carolina, who was wanted on drug charges in his home state. Miller had been hiding from authorities in Norwich for a few weeks, he was located at a residence on Columbia Street & was taken into custody. Miller was arraigned in a Federal Courtroom in Binghamton & he will be extradited back to North Carolina shortly.

State Police are warning the public about another phone scam, where the caller pretends to be with the State Police and asks for your personal information. The Caller may even say that there is a case pending against the victim of the scam call. The Broome County Special Investigations Unit Task arrested 50-year-old David Rexer of Endicott for attempted murder, conspiracy, and attempted arson, Rexer is accused of conspiring with a 2nd person to commit arson on a home with people inside in the Village of Endicott. Governor Kathy Hochul today announced the opening of the initial intake tool to help small businesses determine their eligibility for the COVID-19 Capital Costs Tax Credit Program. The $250 million Program will support small businesses that made investments to comply with emergency orders and regulations or to increase public safety in response to COVID-19. Governor Hochul is bringing state lawmakers back to Albany on Thursday to consider gun safety legislation in response to the Supreme Court striking down key portions of the state’s licensing law. The court on Thursday overturned the state law that required that people applying for a concealed carry permit demonstrate a specific need to have a gun in public. New York officials are considering restrictions on concealed carry in “sensitive locations,” such as government buildings and bars. They’re also looking at implementing specific training for permit applicants, among other options.

$178.8 million has been awarded to 75 communities across New York State for projects that promote environmentally friendly modes of travel and make it easier and safer to walk, bike or hike. Locally, $5,000,000 will go to the City of Oneonta to construct sidewalks and shoulders for pedestrians and bicycles along State Routes 23 and 28.

Legislation co-sponsored by Assemblywoman Donna Lupardo of Endwell, is elevating care standards at animal shelters and animal rescue organizations in New York State. The new legislation will require shelters to pass state inspections, to be administered under the division of Agriculture and Markets. Violations could result in denial, revocation, suspension or refusal of license renewal as well as possible fines of between $100 and $1,000 per violation. The new standards take effect in 2025.

Governor Cuomo announced today the loosening of restrictions regarding the New York Mets & New York Yankees In their stadiums starting May 19th, where people vaccinated against COVID can sit in adjacent seats at a game, and those who are not will have to maintain social distancing in the ball parks.  Also, Broadway Theater will re-open in September and will be allowed 100% capacity when they re-open, as the COVID positivity rates & Hospitalizations go down.

The state continues to see favorable statistics regarding COVID 19, as Tuesday’s statewide testing showed a positivity rate of 1.49%, the lowest numbers since last October.  The number of decreased by more than 100 to 2658, the number in ICU Beds went down by 15 to 610, and the number of Patients on Ventilators went down slightly to 379.  There were 31 deaths attributed to the COVID virus Tuesday in New York State.

Governor Cuomo signed an extension of the COVID-19 Emergency Eviction and Foreclosure Prevention Act of 2020 and the COVID-19 Emergency Protect Our Small Businesses Act. The legislation extends protections prohibiting residential and commercial evictions, foreclosure proceedings, credit discrimination and negative credit reporting related to the COVID-19 pandemic until August 31st.

State Police found a missing toddler who was allegedly abducted in Minnesota after spotting the suspect’s vehicle on the Thruway Tuesday.   27-year-old Amina Mohamed of Minneapolis, is accused of kidnapping her little sister, 2-year-old Nasteha Mohamed, State police received a ‘be on the lookout’ notification for a gold Chevrolet Equinox, they were stopped near in the town of Elbridge, the child appeared to be in good health & will be in the care of Onondaga County Child Protective Services until she can be safely returned to her mother.   Amina Mohamed was taken into custody, the investigation is ongoing.

The Associated Press reported Wednesday that Former New York Assembly Speaker Sheldon Silver has been released from a federal prison on furlough, while he awaits potential placement to home confinement.  Silver was serving his more than 6-year sentence at a federal prison in Otisville; he began serving his sentence in August on corruption charges.

State Police and Broome County Sheriff’s Deputies were dispatched to a residence on Hall Street in the town of Union to check on the welfare of the resident.  Troopers, Deputies & Endwell Fire Department members located 2 people were found deceased inside the home, they have been identified as 49-year-old Marc McKercher and 48-year-old Cynthia Pratts-Lyons, the investigation is continuing.

State Police arrested 58 year old Martin Lewicki of Norwich for 3rd degree Burglary & Criminal Mischief.   State Police asked for the public’s help in identifying a person who broke into the Balsam Inn in the town of Pharsalia last November, Surveillance video caught the suspect taking neon signs, bar lights, a bar table, bar stools and destroying several items, a tip led investigators to Lewicki, who was arrested, arraigned & was remanded to the Chenango County Jail without bail.

Chenango County Sheriff’s Department arrested 46 year old Christina Clifford of Edmeston following an investigation into forged fraudulent checks being cashed in a Town of North Norwich business. Clifford was charged with 2nd degree Forgery &plus conspiracy & petty larceny, she was taken into custody without incident, & was released to on an appearance ticket to appear in the Town of North Norwich Court at a later date.

Chenango County Correctional Officers discovered an unconscious male inmate in his cell Wednesday.    22 year old Dillin Button was pronounced deceased after attempts to revive him were unsuccessful.  The autopsy ruled his death as a result of a bacterial blood infection of the heart and pneumonia, it was revealed that 2 weeks earlier that Button was diagnosed with a bacterial blood infection and pneumonia at an area hospital & he checked himself out of before receiving complete treatment.

Beginning March 29th statewide travel for sports and recreational activities will be permitted. The New York Mets and New York Yankees can resume play with spectators in their stadiums, beginning April 1st, with 20% capacity allowed, along with other COVID protocols in place.

Delaware County Public Health reported 19 new COVID 19 cases Thursday out of 352 tested.  They report 111 active cases, 7 hospitalized & 354 in quarantine.

The State Health Department reported that on Wednesday over 271,000 COVID tests were given statewide, with 2.87% testing positive.  Patient hospitalizations, the number of patients in an ICU bed & the number on ventilators continue to decline, there were 57 deaths from the virus.

Secretary to the Governor Melissa DeRosa is under fire, for saying to some state lawmakers in a ZOOM meeting that the administration “Froze Up” after being asked last summer for information by the US Department of Justice, regarding the death toll in the state’s nursing homes from COVID 19. The State Health Department has released updated statistics in the last week that greatly increased the number of deaths of Nursing home residents to over 12,700, by including those who died from COVID while in a hospital.  This Afternoon, DeRosa clarified her statements by stating that Governor’s Office had asked State Lawmakers to wait for the administration’s response on Nursing Home deaths, so the administration could first resolve the Federal inquiry, she said that they were fully transparent with the Federal & then state inquiries in that order.  Some Lawmakers are calling for limiting the Governor’s emergency powers & for the resignations of DeRosa; many have also been calling for the resignation of State Health Commissioner Dr. Howard Zucker.

Major League Baseball announced today that all 120 Minor League Clubs offered an invitation to become Professional Development League (“PDL”) license holders, have officially agreed to accept. State Police arrested 33 year old Carlos Smith of Utica, for torturing, injuring & failing to feed 6 dogs left at his former residence in the town of Davenport in December.  Smith was officially charged with 6 counts of failing to provide proper sustenance to animals; a warrant was issued for his arrest, which occurred late Thursday afternoon.

State Police located 15 year old Trevor Mallory in the City in Binghamton in good health; he was turned over to the custody of a family member.  Mallory was reported missing on February 2nd, where he was last seen leaving the town of Colesville in a vehicle.  State Police stated that tips from the public & and the sharing of Mallory’s picture on social media led to his reappearance.

State Police updated their information regarding Thursday’s crash of a garbage truck on State Route 17 in the town of Windsor.  The unidentified 64 year old driver from the Bronx was traveling at an unsafe speed, and made an unsafe lane change, he went through the guiderail and into the median, struck an earth embankment, the truck continued & the tractor became detached & overturned and came to rest in the median between the over passes for State Line Road.  The driver was taken to Wilson Hospital in Johnson City, the truck is registered to Lae Transport Corp in Newark, New Jersey, the investigation is continuing.

Jury selection began Tuesday in Otsego County Court for the Murder & Arson Trial of 33 year old Gabriel Pruitt of Oneonta.  Pruitt is accused of setting a fire at 5 Walling Avenue in Oneonta on December 29th 2018 that killed John Heller as he tried to get his family out of the building.

The Greene Central School District reported that at approximately 3:30 Tuesday afternoon, a vehicle belonging to Greene Central School District was involved in a 1-car accident on Genegantslet Road. Officials said that there were 2 occupants; the driver & a bus monitor, NO students were in the vehicle. The vehicle left the road and struck a tree. Both patients were transported to a local hospital. The investigation into the accident is continuing.

The New York Mets announced today that Binghamton Rumble Ponies All Star & former Heisman Trophy winner Tim Tebow has a broken hamate bone in his right hand that will require surgery, and he is likely out for the season. 34 year old Tristan Reid of Scranton Pennsylvania was charged with reckless endangerment, reckless driving, unlicensed operator, leaving the scene of a property damage accident, & several other related charges, following an accident on Main Street last Friday evening. Delaware County Sheriff’s Deputies arrested 56 year old Patrick Macdonald of Walton, New York on charges of Driving While Intoxicated, Aggravated DWI with a blood alcohol content of .18 or higher, and Obstructing Governmental Administration, Unlawfully Fleeing a Police Officer in a Motor Vehicle, and Reckless Driving, as well as numerous vehicle and traffic violations. This arrest was a result of a police pursuit beginning in the Town of Walton and concluding in the Town of Franklin. State Police seized methamphetamine oil, 2 grams of meth, a sawed off shotgun, a digital scale and components used to make methamphetamine. The state Health Department stated that Adults aged 65 years and older, people with certain chronic medical conditions, young children and pregnant women are among those at highest risk for serious influenza complications, which may require hospitalization and could result in death. Officials strongly suggest that New Yorkers get their flu shots as soon as possible.

State Police arrested 37-year-old Alexander Rogers of Otego, for Criminal Mischief. A State Parole Officer advised troopers that Rogers had intentionally damage his GPS monitoring ankle bracelet while attempting to remove it. Rogers was issued a ticket returnable to the town of Otego Court on January 25, he was turned over to the custody of the parole officers.

55-year-old David Schaffer of Pharsalia was arrested by the Chenango County Sheriff’s Department for Sexual Abuse, Forcible Touching & Endangering the welfare of a child. Shaffer is accused of performing sexual acts with a child under the age of 13 in Pharsalia; Shaffer was arraigned in Village of Smyrna Court and will reappear in court at a later date.

State Comptroller Tom DiNapoli announced the results of the audit of the State Commission of Corrections, which is the state agency in charge of the oversight and inspection of 561 state and local correctional facilities and jails across the state. The audit said that the commission is not tracking or analyzing incidents and inmate complaints that may indicate problematic trends at those facilities, Auditors also found the Commission is not routinely inspecting the state’s 54 prisons. The New York Mets announced today that former Heisman Trophy winner and NFL quarterback Tim Tebow will be invited to Spring training with the New York Mets in February. The 30-year-old athlete is preparing for his 2nd professional baseball season, he hit .226 with 8 homers & 52 Runs Batted In in 126 games last year at Class A Columbia and Port St. Lucie.

The Unadilla Town Board will hold a special meeting today at 4:00 PM at the Unadilla Town Hall on State Route 7. The board will consider adopting a resolution adopting the Community Choice Aggregation program, Education & Outreach Plan, & the Customer Opt Out letter, for a lower cost Electrical plan. Marble left her residence Sunday evening without medication that she needs for a serious medical condition, she left her cell phone and her dog behind & she missed a meeting with friends in Amsterdam on Sunday evening. Marble’s car is a black 2015 Honda CRV, it entered the State Thruway at Exit 25A, Interstate 88, and left at Exit 25, she may have re-entered the Thruway at Exit 27 & and left at Exit 34, Canastota, at about 4:00 AM Monday. Marble is 5’ 2” tall, weighs about 140 pounds and has blue eyes and brown hair; her license plate number is “DBK1402”. Anyone with information can call state police at (518) 783-3211.

U.S. Senator Chuck Schumer visited upstate Monday, where he expressed his support for a proposal to place rollover bars on farm tractors. Schumer cited statistics that show that farmers are 8 times more likely to die on the job than most workers. Schumer said that the Trump administration’s proposed budget for 2018, cuts the Northeast Center for Occupation Safety and Health for Agriculture, Forestry and Fishing, which is a rebate program that helps farmers purchase lifesaving equipment, including the “rollover bars.” The program is supported by the National Tractor Safety Council.

Delaware County Sheriff’s Deputies arrested and charged 49-year-old William Scherer of Bloomville for DWI, Driving with Blood Alcohol Content above .08%, and Aggravated Unlicensed Operation of a Motor Vehicle, during a traffic stop in the Town of Kortright. Deputies responded to a report of an erratic operator, Scherer was released on appearance tickets, and scheduled to appear at the Town of Kortright Court at a later date.

Governor Cuomo’s office announced that the New York Mets will be moving their Triple A minor league team form Las Vegas to Syracuse, after the team bought the Syracuse Chiefs franchise. The acquisition puts the Mets top 2 level farm teams in upstate New York, as Double A Binghamton has been affiliated with the Mets since the early 90’s. The Washington Nationals have had their Triple A team in Syracuse for several years, and they will need to relocate.

Governor Cuomo today announced that 118 names would be added to the State Fallen Firefighters Memorial at the Empire State Plaza in Albany. Cuomo stated that of the 118, 114 firefighters suffered injuries and illnesses as a result of their efforts following 9/11. The Fallen Firefighters Memorial now honors 2,524 individuals who lost their lives in the line of duty. Governor Cuomo also issued 2 proclamations, marking Today as Firefighter Appreciation Day and the week of October 8th to the 14th as Fire Prevention Week.

The Delaware County Office for the Aging announced today that they are moving to their new location at 97 Main Street in Delhi. The agency will be closed for business tomorrow through this Friday; any emergency situation regarding the Office should be forwarded to the Delaware County Sheriff’s Department at 832-5555. The Office for the Aging will re-open at the new location on Monday, October 16th.

A new report from State Comptroller Tom DiNapoli estimates that locally owned bridges need $27 billion in repairs, with 13% of all locally owned bridges are considered structurally deficient. The report suggests that repairs or upgrades are needed to support heavier loads, while others are prone to, or have been damaged by floods. DiNapoli’s report states that local officials will have to work with their state and federal counterparts to ensure there’s money to pay for critical repairs. Locally, Delaware County had 6.9% of their bridge structurally deficient, Chenango County has 12.2%, and Otsego County had 14%.
